§ 23-137. Alignment.

  • (a)

    Roads shall be centered in the dedicated public right-of-way unless variations are approved by the Director.

    (b)

    If the established right-of-way is not of sufficient width to construct the roadway in accordance with the Design and Construction Standards currently in effect, the applicant may be required to obtain and dedicate to public use, or deed to the County, additional right-of-way and/or easements, as needed, to construct the road to the approved standard. Where the applicant has been unable to acquire the necessary right-of-way and/or easements, the County may obtain the right-of-way or easements and charge all costs incurred to the applicant/permittee.
