§ 27A-105. Conflicting Ordinances.

  • (a)

    Whenever any provision of this Subtitle imposes a greater requirement or a higher standard than is required in any State or Federal statute or other County ordinance or regulation, the provisions of this Subtitle shall govern unless preempted by State or Federal law.

    (b)

    Whenever any provision of a State or Federal statute or other County ordinance or regulation imposes a greater requirement or a higher standard than required by this Subtitle, the provision of the State or Federal statute or other County ordinance or regulation shall govern. Whenever any provision of a State or Federal statute or other County ordinance or regulation imposes a greater requirement or a higher standard than required by this Subtitle, the provision of the State or Federal statute or other County ordinance or regulation shall govern.

    (c)

    It is not the intent of this Subtitle to interfere with or annul any easements, covenants, or other agreements between parties; provided that where this Subtitle imposes a greater restriction upon the use and dimensions of buildings, structures, or land, or requires larger open spaces than are imposed or required by other ordinances, regulations, or permits, or by easements, covenants, or agreements, the provisions of this Subtitle shall govern, except where expressly qualified in it.
