§ 32-199. Penalties.

  • (a)

    Any person convicted of violating the provisions of this Division shall be guilty of a misdemeanor, and upon conviction thereof, shall be subject to a fine of not more than Ten Thousand Dollars ($10,000.00), or imprisonment not exceeding one (1) year, or both, for each violation, with costs imposed at the discretion of the court and not to exceed Fifty Thousand Dollars ($50,000.00).

    (b)

    Each day that the violation continues shall be a separate offense.

    (c)

    In addition, the County Attorney may institute injunctive mandamus or other appropriate action or proceedings at law or equity for the enforcement of this Division or to correct violations of this Division, and any court of competent jurisdiction shall have the right to issue restraining orders, temporary or permanent injunctions, mandamus or other appropriate forms of remedy or relief.
